In death note is this a plot hole ?

When kyosuke higuchi picks up misa in his car. Misa orders rem to kill higuchi's rival to prove that she was the second kira. But when shinigami kill out of love for a human they die. So how did rem survive that part when she killed the guy ultimately for misa's happiness ?
